Our office’s defense team, in cooperation with the Tebyan Foundation for Rights and Freedoms, filed a memorandum setting out the grounds for a cassation appeal against the judgment issued against poet and human-rights defender Ahmed Douma, which sentenced him to one year in prison with hard labor and immediate enforcement and fined him 200 Egyptian pounds. The case dates back to April 6, 2026, when the Supreme State Security Prosecution questioned Douma over an article he published on the Al Araby Al Jadeed website titled “From Prison Within the State to the State Within Prison,” before referring him for trial on April 27 under Articles 80(d/1) and 102 bis of the Penal Code. On June 3, 2026, the New Cairo Misdemeanors Court sentenced Douma to one year in prison with hard labor and immediate enforcement and fined him 200 Egyptian pounds, over allegations that he broadcast false news and statements about the country’s internal conditions, in Case No. 4894 of 2026, Fifth Settlement Misdemeanors. The New Cairo Misdemeanors Appeals Court upheld the judgment at its hearing on July 16, 2026, in Case No. 6065 of 2026, New Cairo Misdemeanors Appeals. The appeal memorandum requested a stay of enforcement of the challenged judgment and authorization to initiate proceedings challenging the constitutionality of the wording of the two charging provisions, on the grounds that they violated Article 71 of the Constitution. It also maintained that the judgment was marred by errors in the application and interpretation of the law, flawed reasoning, insufficient grounds, and infringement of the rights of the defense. Douma had previously spent more than ten years in prison over cases related to his political activity, before being released under a presidential pardon in August 2023, following human-rights and political demands for his release. From his release until his reimprisonment in the current case, investigative authorities summoned Douma in seven cases, and he was released in six of them on financial bail totaling 230,000 Egyptian pounds. The Tebyan Foundation for Rights and Freedoms continues to provide Ahmed Douma with legal support and follow the appeal procedures, thereby ensuring fair-trial guarantees and protecting his right to freedom of expression. The Fifth Settlement Misdemeanors Appeals Court had ruled to uphold the first-instance judgment sentencing poet and writer Ahmed Douma to one year in prison.
