Trump Administration Asks Supreme Court to Resume Big Bend Border Construction

The Trump administration asked the U.S. Supreme Court on October 21 to suspend an injunction blocking border-barrier construction and related ground disturbance in the Big Bend Sector of West Texas. U.S. District Judge Kathleen Cardone issued the injunction on October 2 in a challenge to the Department of Homeland Security's waivers of environmental and other legal requirements. The government argues that federal law expressly authorizes those waivers and also seeks summary reversal of the injunction. Its filing cites a Customs and Border Protection estimate that suspended work costs more than $460,000 per day.
